RULES & REGULATIONS
The rights and obligations of a client submitting an order are contained in the Gatta-panty General Conditions. They also include the requirement to provide detailed description and photo of a given product. We would like to ask you to closely acquaint yourself with the conditions and contact us in case of any queries.
SCOPE OF APPLICATION OF GENERAL CONDITIONS
The General Conditions (hereunder referred to as: Conditions) apply to all the Gatta-panty offers, orders and agreements. Use of any other Conditions (General) is excluded.
Ordering through our website is equivalent to accepting the Conditions.
Departure from the Conditions can be valid only in writing. In case of a departure from a given provision of the Conditions, such a departure does not affect the validity of other provisions.
In case of any provision of the Conditions being contrary to the law, the Gatta-panty will promptly amend such a provision. Such an amendment will bear no influence upon other provisions of the Conditions.
In case when given provisions at a given time are applied in a more flexible manner the Gatta-panty retains the right to return to their strict application..
Employees, intermediaries, agents and other third parties dealing with Gatta-panty may refer to the given Conditions.
Gatta-panty is entitled to amend the Conditions. Such amended conditions start applying at the moment when the new version of Conditions appears in the website www.gatta-panty.nl. With the exception of cases when the amended Conditions are more favourable to the Client that the preceding ones, they do not cover orders submitted before such amended Conditions were published on www.gatta-panty.nl.
ARTICLES
Gatta-panty guarantee that all the articles in the offer comply with specifications as well as the requirements concerning durability and usefulness, and that at the time of signing the agreement the use of the articles in not contrary to the law or state regulations.
Gatta-panty makes every effort to ensure that all the articles correspond as closely as possible to their descriptions and photos.

Gatta-panty offers products from various collections. We take care to order the products from our suppliers in due time but it can happen that a given product is unavailable. As soon as Gatta-panty receives such an information, the unavailable product is withdrawn from the shop’s offer.
AGREEMENT, PRICES & PAYMENTS
Gatta-panty does its best to ensure that acceptance and realization of orders is executed with the utmost care.
An agreement is concluded at the moment of transferring the whole due sum to the Gatta-panty account, as well as after Gatta-panty accepts your order and receives appropriate information required for its execution.
Gatta-panty offers two possibilities of payment:
- by a transfer to the bank account: 1537.74.053 owned by depa&kuczynsky.
- by iDEAL safe payment. More information about this type of payment can be found at www.ideal.nl.
Gatta-panty has the right to refuse an order or particular conditions of its realization. In case the order is not accepted, Gatta-panty will inform you of the fact within ten (10) days of reception of order.
Delivery takes place after receiving the due sum in our bank account. We do not execute orders with payments upon delivery or orders only partially paid.
In case of order already paid for, and the agreement to which the payment relates to not coming into effect (e.g. because the given article was already sold out) or the agreement being cancelled, Gatta-panty returns the sum paid by the Client to his/her account within thirty (30) days.
Gatta-panty reserves the right to change prices, in particular in cases resulting from the (legal) regulations.
In case when the price of a given article is increased during the realization of your order, Getta-panty will not take such an increase into account.
All the prices on our website are given in Euro and include VAT, however they do not include the cost of delivery!
For preparation of the parcel, its control, freight and delivery within Holland, Gatta-panty charges the sum of Euro 2.95.

DESPATCH AND TIME OF SHIPMENT
Gatta-panty tries to deliver the articles of the accepted orders as fast as possible, however the period of delivery may take from two (2) days to two (2) weeks.
The aforementioned two-weekly period of delivery is not bounding. Client is not entitled to compensation in cases of longer delivery period. Client may cancel the order when the delivery period exceeds one (1) month.
You will be informed in case when the order cannot be executed or when it can be executed only partially.
In case the delivery of an article is not possible, Gatta-panty will try to find a replacement article which will be however forwarded only following previous agreement with the Client.
Supply of an article is completed at the moment of its delivery at the given address.
Before opening the packaging please check the product’s size and colour. In case when the product packaging is damaged which could cause the damage of the contained article please do not take it out and get in touch with Gatta-panty as soon as possible.
In case of receiving articles which you did not order please inform of the fact Gatta-panty as soon as possible.
In case of noticing an error in the data we transferred/provided or in the data concerning yourself, please do contact Gatta-panty as soon as possible.
Information concerning change of address should be always delivered to Gatta-panty in writing. In case when the ordered article has been already posted Gatta-panty is not to be held responsible for problems which may possibly result from such a situation. You will receive an e-mail with the information concerning the date we dispatched your order.
COMPLAINTS, EXCHANGES AND RETURNS
At the moment of receipt of the order the Client should check – without opening the packaging – whether the delivered article correspond to the one agreed upon! Any case when the delivered article does not comply with the conditions of the agreement should be reported to Gatta-panty within seven (7) working days from the date of delivery. Such notification should specify the reasons for which the given article does not comply with the conditions of the agreement.
In case when given article does not comply with the conditions of the agreement you can chose one of the following solutions:
- once more order the article by email (info@gatta-panty.nl),
- ask for a refund of the sum paid for the ordered article.
In both cases the Client is obligated within ten (10) working days from receiving the article to send it back to Gatta-panty in an undamaged condition (with intact seal). After receiving the returned article we will dispatch the proper article or we will refund the sum paid.
The refund of the sum paid for the article is always made into the same bank account from which the transfer was originally made
In case when the article is not returned in accordance with the aforementioned conditions, its exchange for another one or a refund of the sum paid for it will not be possible.
The costs of returning the product are covered by the Client.
With the view of ensuring proper conduct of the above described procedure we will maintain an e-mail contact with the Client.
OTHER MATTERS
In case of an occurrence of force majeure Gatta-panty may (temporarily) withhold realisation of an order and/or cancel the agreement, which in no case could constitute the reason for compensation claims. The Client will be informed of such a situation.
While executing an order Gatta-panty may use the third-party services.
Gatta-panty shell not be liable for errors (printed) in the website and/or other advertising/promotional material as well as information provided by the users of the website, or for other damages resulted from use of the hereby website.
The hereby Conditions and all the matters contained therein are subject to the Dutch law only. Any disputes will be resolved by the eligible Dutch court.
The Gatta-panty website is the property of the registered partnership V.O.F. Depa&Kuczynsky. It is prohibited to publish its content without the written consent of V.O.F. Depa&Kuczynsky.
POLICY OF PRIVACY
We keep only the e-mail addresses which were sent directly to Gatta-panty or which were intended to reach us.
Gatta-panty uses given e-mail address solely for the sake of sending information designated to the Client (new collections, etc.). At any instance you may discontinue reception of Gatta-panty information. The e-mail addresses under no circumstances are transferred to third parties.
Your personal data is used solely for undertaking and realization of the agreement, and for mutual contacts. Gatta-panty may use these data so as to inform you about novelties and interesting promotions.
